Hungry Jacks have found themselves in legal hot water after their burger nemesis, McDonald’s accused the chain of ripping of the iconic Big Mac.

As The Guardian report, a federal court lawsuit filed on Monday saw McDonald’s claim Hungry Jack’s “deliberately adopted or imitated” the “distinctive appearance or build” of the Big Mac. In addition to the physical similarities, they accuse Hungry Jacks of ganking the Big Mac tagline “two all-beef patties, special sauce, lettuce, cheese, pickles, onions – on a sesame seed bun”, that has been used to promote the burger since 1974.

Hungry Jack’s Big Jack burger has been marketed as “two flame-grilled 100% Aussie beef patties, topped with melted cheese, special sauce, fresh lettuce, pickles and onions on a toasted sesame seed bun”.

I mean it’s obvious that Hungry Jack’s are taking the piss here and I’ve never respected a fast-food conglomerate more. This is all one elaborate, probably expensive troll.

The legal fisticuff doesn’t end there. After the Big Jack burger hit the market, Hungry Jacks amped things up with the artery-killing burger the Mega Jack. Very on the nose torment considering the steroid version of the Big Mac is the Mega Mac. Maccas claim Hungry Jacks registering the Big Jack trademark was done “in bad faith”.

McDonald’s claims detail that Hungry Jacks has refused to observe demands to stop selling the Big and Mega Jacks.

The suit asks that the Federal Court make orders restraining Hungry Jack’s from using the Big Jacks trademarks or any that may be “substantially identical or deceptively similar” to McDonald’s trademarks. As well as seeking an order cancelling the Big Jack trademark.

McDonald’s is also seeking damages, and the destruction of “of all promotional materials, including physical and electronic brochures, menus, advertising and marketing materials, stationary, signage, packaging and documents” bearing the Big Jack branding.
